NOTICE
OF PUBLIC HEARING
The New Mexico Department of Health
will hold a public hearing on the adoption of a new rule, 7.5.5 NMAC, “New
Mexico Statewide Immunization Registry.” The hearing will be held on September 13, 2018
at 9:00 a.m. in the auditorium of the Harold Runnels Building, located at 1190
St. Francis Drive in Santa Fe, New Mexico. This hearing will be conducted to receive
public comment regarding the proposed adoption of a new rule governing the required
use of the New Mexico statewide immunization registry, a computerized
repository of immunization information maintained by the New Mexico Department
of Health.
The proposed new
rule is to regulate the registry portion of the New Mexico Immunization Act,
NMSA 1978, Sections 24-5-7 through 24-5-15, which
requires physicians, nurses, pharmacists and other health care providers to
report immunization information to the statewide registry. These rules describe implementation of the
registry, including maintenance, submission, reporting, participation, sanctions,
and limits on access to the registry.
The legal authority for the
proposed rule and the adoption of the rule by the Department is under Subsection E of Section 9-7-6 NMSA 1978,
Sections 24-5-7 through 24-5-15 NMSA 1978, Subsection R of Section 24-1-3 NMSA
1978, and Section 24-1-21 NMSA.

The public hearing will be
conducted to receive public comment on the proposed new rule 7.5.5 NMAC. Any interested member of the public may attend
the hearing and submit data, views, or arguments either orally or in writing on
the proposed new rule during the hearing. Written public comment may also be submitted
prior to the date of the hearing. Please
submit any written comments regarding the proposed new rule 7.5.5 NMAC to the

comments will be published on the agency website at https://nmhealth.org/about/asd/cmo/rules/ within 3 days of receipt, and will be
available at the New Mexico Department of Health Office of General Counsel for
public inspection.
