NOTICE OF PUBLIC HEARING

 

 

The New Mexico Department of Public Safety (DPS) will hold a public hearing at the Law Enforcement Academy Auditorium, 4491 Cerrillos Road, Santa Fe, NM, 87507, on December 4, 2019 at 1:30 p.m.

 

The purpose of this public hearing is to receive public comment and input on the proposed Rule 10.2.200 NMAC Expungement of Arrest Records and Related Public Records that implements the Criminal Records Expungement Act, and establishes requirements and procedures for obtaining information from DPS to expunge arrest and public records.  The proposed rule is promulgated pursuant to Section 29-3A-6 NMSA 1978.

 

This rule defines pertinent terms, advises the public of the need to obtain a DPS arrest and prosecution record [RAP], an FBI RAP sheet and how to obtain them  The rule also provides information needed to serve  DPS by certified mail or commercial carrier. 

 

Interested persons may comment at the public hearing or submit written statements to DPS c/o Angela Martinez, 4491 Cerrillos Road, P.O. Box 1628, Santa Fe, NM 87504, or by electronic mail to: Angela.Martinez2@state.nm.us.  All written statements must be received no later than November 30, 2019, or at the public hearing.  Early submission of written statements is encouraged.
