NOTICE OF PROPOSED RULEMAKING
NOTICE IS HEREBY GIVEN that the Superintendent of Insurance (“Superintendent”),
pursuant to the New Mexico Insurance Code, Sections 59A-l -1 et seq. NMSA 1978 (“Insurance
Code”) and 13.1.4 NMAC, proposes to
adopt a new rule, 13.10.31 NMAC, PRIOR AUTHORIZATION, and to repeal conflicting
parts of 13.10.17 NMAC GRIEVANCE PROCEDURES
PURPOSE OF THE PROPOSED NEW RULE IS: to establish and standardize oversight, reporting,
transparency and confidentiality procedures for prior authorization processes.
STATUTORY
AUTHORITY: Section 59A-15-20 NMSA 1978; Sections 59A-22B-1 through
59A-22B-7 NMSA 1978; and Sections 59A-57-1 through 59A-57-11 NMSA 1978.

OSI
will hold a public video/telephonic hearing on the proposed rule on February 16,
2021 at 9:00 a.m.

Superintendent designates R. Alfred Walker to act as the hearing officer for
this rulemaking. Oral comments will be
accepted at the video/telephonic hearing from members of the public and any
interested parties.
Written comments and proposals will be accepted
through 4:00 pm on February 16, 2021. Responses to written comments or oral comments
will be accepted through 4:00 pm on February 26, 2021. Comments may be submitted via email to OSI-docketfiling@state.nm.us
