9.5.2.6                    Objective:  This rule establishes the bylaws of the commission pursuant to Section 73-31-4 NMSA 1953 [now 28-12-6 NMSA 1978], which provides that the "commission shall organize by the election of a vice chairman and a secretary, and by the adoption of rules and regulations pertinent to the conduct of the business of the commission."

9.5.2.8                    Meetings:  The commission shall meet at least once every quarter at such time and place as may be determined by the commission and shall hold such other meetings as may be called by the chairman, in accordance with statutory requirement.

9.5.2.9                    Notice of meetings:  Notice of time and place of each regular or special meeting shall be given each member prior to the date of said meeting.

9.5.2.10                 Organization:  The chairman shall be appointed by and serve at the pleasure of the governor, as provided by statute. The vice chairman and secretary shall be elected by the commission from among its membership and shall serve at the pleasure of the commission.

9.5.2.11                 Conduct of business:  A majority of the total members must be present in person at any regular or special meeting in order to constitute a quorum for the conduct of business. The affirmative vote of the majority of the members present shall be necessary to authorize any action by the commission.

9.5.2.12                 Attendance at meetings:  If any member of the commission fails to attend any four consecutive meetings called by the chairman; and if there is no indication that the absences are warranted or that such member intends to fulfill his/her obligation as a member, then the chairman shall so advise the governor.

9.5.2.13                 Amendments:  Amendments hereto must be presented in writing to each member of the commission in advance of a meeting and shall be voted upon at the next regular or special meeting.
