NOTICE OF RULEMAKING
The
New Mexico Health Care Authority (HCA), through the Medical Assistance Division
(MAD), is proposing New Mexico Administrative Code (NMAC) rule 8.321.12,
Specialized Behavioral Health Services, Certified Community Behavioral Health
Clinics (CCBHC). CCBHC is a new Medicaid program, effective January 1, 2025. This is a new section of the NMAC to
establish rules for the CCBHC program in New Mexico.
Section
9-8-6 NMSA 1978, authorizes the Department Secretary to promulgate rules and
regulations that may be necessary to carry out the duties of the Department and
its divisions.

Background
These
rules establish the CCBHC program, define the criteria and process that the HCA
and the Children, Youth and Families Department shall use to recognize and
verify CCBHCs and provides instruction for service provision under the New
Mexico medical assistance program (MAP). These rules
specify the standards for the CCBHC application, certification, payment and
oversight process.

II. EFFECTIVE
DATE
The
HCA proposes implementing this rule effective December 1, 2025.
III. PUBLIC HEARING
A public hearing to receive testimony on
this proposed rule will be held on July 25, 2025, at 9:30 a.m. Mountain
Time. The hearing will be held at the
Administrative Services Division (ASD), 1474 Rodeo Rd, Santa Fe, NM 87505 and
via Microsoft Teams.
